The Spare Room Hire Agreement

General Information 

The Spare Room is bookable 7 Days a week, however customers should be aware “Open House” may be open for trade during the hours of rental and a certain level of noise may travel to basement level due to this. Opening times of Open House can be found on our website and can be discussed prior to booking. 

We accept cash, bank transfer or card payment, prior to hire. 

The individual booking the room hire, will be responsible for the careful handling of all materials and premises within The Spare Room. In the event of loss or damage to equipment, materials or premises, this individual will be charged for the full repair or replacement.

Definitions

“the Client” means any person or organisation hiring The Spare Room or any agent, representative, servant, employee or subcontractor of such person or organisation. 

“the Equipment” means all fixtures and fittings and all equipment existing in or provided by The Spare Room, including but not exclusive to lighting, tables, chairs and kitchen appliances. “The Spare Room” means Open House & The Spare Room, 504 Durham Road, Low Fell, Gateshead NE9 6HU. 

Hire Fees 

The hire fee is charged at an hourly rate of £15, all hires are bookable between the hours of 09:00am – 09:00pm depending on availability. Overtime of any room hire will be charged at £15 per hour, with a minimum 1-hour charge. Additional costs or reductions may be applicable upon prior agreement and with advanced written confirmation by The Spare Room. 

Booking and Cancellations 

A deposit of 50% is required to secure any booking. This is a non-transferable and non- refundable deposit and is only applicable for the day of requested booking. Room bookings are not confirmed until receipt of the 50% deposit. The Client’s date will not be held until this payment is received and cleared. If the Room Hire must be cancelled by us, the Client will receive a full refund of the deposit. The deposit payment must be received before the Client’s reserved time begins. If the Client cancels the reservation without at least 24hrs notice the Client is liable for the full cost of the reserved time and will be invoiced accordingly. The Spare Room reserves the right to refuse reservations at its sole discretion. 

Payment Terms 

For all Room hire bookings, payments must be made in full or in advance of the date of booking. In certain circumstances pre-approved commercial Client accounts are available for bookings. 

Equipment

We agree to provide equipment/facilities in good working order but make no guarantees on equipment’s functionality or suitability to the Client’s purposes. Any Equipment lost, damaged or stolen will be charged to the Client at its full replacement cost. The Client may not remove any Equipment from the Room premises and all Equipment must be returned promptly at the end of the hire period and in good condition. The Client is solely responsible for any breakages or damage to supplied equipment. 

Room Premises 

The Client shall be responsible for all or any costs or expenses incurred by us as a result of any damage by the Client to the premises. No alterations decorations or additions to the Room are permitted without our prior consent. At the end of the hire period, the Room must be in the same condition that it was in, at the start of the hire period. 

Length of Use 

Room clean up must be completed by the end of the rental period. If the studio is not returned to the state it was prior to the rental period, the Client will be charged a clean- up fee of one hour’s full rate overtime (£15). Do not arrive late, the Client’s rental time begins promptly at the designated starting time and ends promptly at the designated ending time. There will be no exceptions to this. You will be instructed 15mins prior to the end of your allocated time if the Client wishes to take extra time after the Clients allocated time, this must be agreed between the Client and us at this time and any further payment will be paid. 

Terms of Use 

Use of the Room and equipment is at the Client's own risk. The Client hereby waives rights to seek legal compensation for mishaps, accidents, and/or loss while on the premises. The Client agrees to leave the Room in the same condition as when the Client arrived. The Client is solely responsible for any legal infractions they or members of their party make during the conduct of the hire. The Client agrees to be solely responsible for the conduct and welfare of all persons accompanying the Client whilst on our premises. The Client understands that if we observe that dangerous or negligent practices or activities are being engaged in the room, we reserve the right to require the Client and the Client’s party to leave immediately. However, we assume no responsibility to act in such cases. The Client agrees to hold Open House & The Spare Room, its agents, representatives, and anyone acting on behalf of the Room completely harmless from any action, legal or otherwise, that results from the Client’s conduct. Save in respect of anything which cannot be excluded by Statute, neither the Manager nor Open House & The Spare Room takes responsibility for any loss or damages suffered by the Client, caused by, or arising from its use of the Room or any Equipment. All equipment and valuables brought on to the premises by the Client shall be at the Client’s own risk. It is in the Client’s best interests to make sure that they have sufficient insurance to cover themselves and their equipment. The Client agrees to hold harmless Open House and The Spare Room, its owner, agents, representatives and contractors acting on its behalf for any loss, accident, or injury to The Client’s self or anyone who accompanies The Client whilst on our premises. 

The Client must produce on demand relevant proof of age and proof of identity of the whole party and other persons on the premises at any time, to include any assistants or any other person involved in the Clients party at any time. No exceptions will be made and we reserve the right to stop any hire and ask the Client and any of their parties to leave the Room premises at any time. These terms and conditions shall be read and construed in accordance with English Law.
